Terms of Service
PREAMBLE
1. These general terms and conditions of sale are agreed between Casca Rija, Lda, with headquarters at Rua do Algar D’Água S/N, 2495-405 Fátima, Portugal, tax identification number 514362219 and contact +351 911 155 444 (custo de chamada para rede móvel nacional, conforme tarifário do utilizador), doravante designada por “Casca Rijae people who wish to make purchases through the website www.cascarija.pt doravante designadas por "Utilizador".
2nd The parties agree that purchases made through the website www.cascarija.pt will be regulated exclusively by this contract, excluding any conditions previously available on the website.
ARTICLE 1 – OBJECT
- As these general terms and conditions of sale aim to provide and define all the necessary information to User about the order, sale, payment, and delivery methods for purchases made on the website www.cascarija.pt.
- These conditions govern all the necessary steps to place the order and ensure the tracking of the order and service provision between the Contracting Parties.
ARTIGO 2 – ORDER
- O Utilizador finalize your order by completing the purchase process presented on the website www.cascarija.pt, adding the product(s) and/or service(s) you wish to order to the shopping cart:
- To receive your order the User could:
- A final confirmation of the order by the User equates to the full and complete acceptance of the prices and description of the products available for sale as well as these General Terms of Sale, which will be the only ones applicable to the contract thus concluded.
- A Casca Rija will honor online orders received up to the limit of available stock. In the absence of availability of the product(s) the Casca Rija commits to inform the User text as soon as possible for you.
- The data on the invoice is the sole responsibility of the User. The invoice, once issued, cannot be reissued with changes.
ARTICLE 3 – PAYMENT
- No website www.cascarija.pttext , a Casca Rija proposes to the User the following payment methods:
- Cartão de Crédito (Visa, Mastercard);
- MB Way;
- Revolut;
- Multibanco Reference;
- Bank Transfer;
ARTICLE 4 – AVAILABILITY AND DELIVERY
- A order fulfillment will be carried out after the payment for the respective order has been confirmed.
- The delivery of orders usually takes place within two business days following the collection of the order by the respective carrier at our facilities. Delivery is carried out by the companies CTT, DPD, or Correos Express.
- If the orders are not over 35€, the shipping cost associated with the order is 6€. When orders are over 35€, there is no shipping cost associated with the order.
- Order requests are valid for seven days, except if the order is registered under a promotional campaign that sets a different deadline, and it is not possible to guarantee the provision of the service, prices, discounts, promotions, and offers beyond this period. If payment is not received by our services within the specified period, the order cannot be validated. Any amount received after this date will be refunded or used in a new order.
ARTIGO 5 – PRICES
- Prices are to be understood in Euros, including taxes and fees, taking into account the VAT in effect at the date of payment of the order.
- If there is an increase or decrease in the prices of any product and/or service, the Utilizador will not be informed, with updated prices always visible and displayed in www.cascarija.pt.
ARTIGO 6 – CANCELLATION, RETURN AND/OR REFUND
The cancellation, return, and/or refund process is handled on a case-by-case basis by the Casca Rija text with the Utilizer.
- Cancellation of a paid order: An order can be canceled after payment. If you want to cancel an order after payment, you must make the request to the contact email store@cascarija.pt and/or the phone contact +351 911 155 444 (custo de chamada para rede móvel nacional, conforme tarifário do utilizador) as soon as possible, so that the order is not shipped before the cancellation notice of the User. The refund will be made via MB Way to the contact associated with the order, if not possible, o User deverá apresentar comprovativos de pagamento e de titularidade de conta ou cartão, para que se realize a devolução por Transferência Bancária corretamente.
- Full order return: if you have received an order and wish to return it in full, you should contact us at e-mail to store@cascarija.pt and/or to the telephone contact +351 911 155 444 (call cost to national mobile network, according to the user's tariff) up to 24h after receiving the order, in order to expedite the return process. If there are no apparent reasons for the return, namely the order being damaged, the cost associated with the return is €6 and must be paid via MB Way as indicated by the Casca Rija. The full refund of the order amount will only be made when the order arrives at the facilities of the Casca Rija totally immaculate, just as it was shipped by Casca Rija ao User. To ensure this, it is necessary that the Utilizador send photos of the order before it is returned again to the Casca Rija, confirming that it was completely immaculate before the return.
- Return and refund of a damaged product: in case the User receives a damaged product in your order, you must report it immediately, up to a maximum of 24 hours after its receipt, to the Casca Rija, through the contact email store@cascarija.pt and/or by phone contact at +351 911 155 444 (custo de chamada para rede móvel nacional, conforme tarifário do utilizador) to explicitly inform the situation with very clear photos. After analysis of the Casca Rija, the product will be collected under the responsibility of the Casca Rija e o User will be refunded with the same amount corresponding to the damaged product.
- The cancellation, return, and/or refund process is handled on a case-by-case basis by the Casca Rija. The order cancellation request and respective refund; the return of the order and respective refund; or the request for a refund of any non-compliant and/or damaged product, must be submitted in writing to the contact email store@cascarija.pt and/or via WhatsApp to the contact +351 911 155 444 (call cost for national mobile network, according to the user's tariff), up to 24h after receiving the order, with the cancellation, return and/or refund instructions for the order or the value of the damaged and/or non-compliant product defined by the Casca Rija, by the same means of communication.
- Whenever possible, the refund should be made through the same payment method, but if this is not possible, the User you must present proof of payment and account or card ownership, so that the refund can be made by Bank Transfer.
- A Casca Rija commits to refund the User no later than seven days.
- In case there are products to be returned to the Casca Rija, they must necessarily be in saleable condition, that is, in the same state as they arrived at User, without any anomaly or damage.
- If the resulting value from exchanging products in an order is lower or higher than the initial value of the same, the adjustment conditions will be indicated by the Casca Rija ao User para sua aprovação afim de chegarem a um entendimento prático entre as partes.
ARTICLE 7 – PRIVACY POLICY
The processing of your data is carried out in compliance with the legislation on personal data protection. The data, subject to computerized processing, will be included in the database(s) of the Casca Rija e are intended for the registration and presentation of other products and services, as well as institutional information, to be provided by them.
Your provision is optional and, under the law, the right of access, rectification, and cancellation of any data that directly concerns you is guaranteed, personally or in writing, directly to the address store@cascarija.pt.
ARTIGO 8 – CONSUMER DISPUTES
For resolution of consumer disputes, contact the National Center for Consumer Conflict Information and Arbitration - CNIACC.
